EVENT PARTICIPATION

1 INTRODUCTION

The following are the terms and conditions (“Terms and Conditions”) for entry to participate in the GUINNESS WORLD RECORDS™ title attempt for the largest disco dance (the “Event”) at Camp Bestival Dorset, operated by Safe Festivals Group Limited, company number 11598107, whose registered office is 30 St. John Street, London, England, EC1M 4AY (“Our”, "Us" and "We”).

These Terms and Conditions are in addition to Our privacy policy, accessible at https://dorset.campbestival.net/info/privacy-policy which governs how We may use the data We collect from you.

Please read these Terms and Conditions carefully. By submitting an entry to participate in the Event, you agree to be bound by these Terms and Conditions. Any amendments or cancellations to these Terms and Conditions will be posted on Our: (i) Facebook page (https://en-gb.facebook.com/campbestival/); (ii) Twitter page (https://twitter.com/CampBestival); (iii) https://www.instagram.com/campbestival/ (iv) TikTok page (v) and website (www.campbestival.net (“Our Website”)).

We reserve the right to disqualify you from participating in the Event if your entry or actions at the Event (as applicable) is/are, or may reasonably be considered to be, (i) defamatory, offensive, libellous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, corporation or entity, encourages conduct that would be considered a criminal offence, gives rise to civil liability, violates any law or is otherwise inappropriate, or contains advertisements or solicitations of business; (ii) includes false or misleading information; or (iii) otherwise breaches these Terms and Conditions.

2 ELIGIBILITY

To enter and participate in the Event you must:

be able to comply with all the Terms and Conditions;

be able to comply with the terms and conditions of GUINNESS WORLD RECORDS (“GWR”) as it relates to participants (https://www.guinnessworldrecords.com/unified-terms/terms-and-conditions/);

be at least 18 years old, unless consent is granted by a legal guardian and such guardian submits an entry on behalf of persons aged between 6 and 17 (proof of consent may be requested by Us); and

be a Camp Bestival Dorset ticket holder for 30 July 2022 (the “Event Date”).

You must not be an employee, agent or a director of, or a member of the family of an employee, agent or director of:

(a) Us or any of Our associated companies or subsidiaries; or

(b) any advertising agency or web company connected with Us.

3 ENTRY REQUIREMENTS

Entries for participation in the Event must be received by Us no later than midnight on 13 July 2022. Any entries received outside this period shall not be considered and such persons shall not be permitted to participate in the Event.

To participate in the Event, you need to sign up and pay a £20 entry fee via Our Website. A portion of the proceeds

of each entry (£5.28 per entry), will be donated to the Ellen MacArthur Cancer Trust

(https://www.ellenmacarthurcancertrust.org/ - a registered charity, charity number 1096491). The donation is separate to any amounts required to obtain a ticket to Camp Bestival Dorset on the Event Date.

Entrants must learn the official 6-minute Event dance routine by way of video tutorial available on Our Website and/or by attending the rehearsal workshops at Camp Bestival Dorset prior to the Event.

In addition to the entry fee stated in condition 3.2, standard mobile data and internet connection charges may apply.

Following submission of an entry and receipt of the entry fee, We will provide confirmation of your participation in the Event.

We cannot be held responsible for entries which are lost or corrupted, or for any entries which We do not receive as a result of any technical error, however caused. In addition, We cannot accept any liability for any difficulties experienced in submitting an entry. Proof of entry or submission will not be proof of receipt by Us.

4 EVENT INFORMATION

4.1 The Event will take place at Camp Bestival Dorset on the Event Date. Participants will be required for a maximum of 1.5 hours on the Event Date and will be notified of the specific times prior to the Event Date.

4.2 Participants under 16 years old must be accompanied by a legal guardian.

4.3 Proof of identification and purchased entry may be required on the Event Date to participate in the Event.

4.4 Each participant will be provided with an exclusive limited-edition Camp Bestival cape to be worn during the Event.

4.5 You agree to comply with Our instructions in relation to the Event, including when at the Event location.

4.6 If, due to circumstances beyond Our reasonable control (including reasons related to Covid), We change the Event date, your entry will be automatically deferred to the new date free of charge.

5 GUINNESS WORLD RECORDS

5.1 You acknowledge that the Event is in connection with GWR, and you agree to comply with GWR’s terms and conditions as it relates to participants, including but not limited to:

authorising Us to act on your behalf as a participant, solely in relation to the Event;

and

complying with clauses 5 and 6 of ARRA (https://www.guinnessworldrecords.com/Images/ARRA-reference-copy-only_tcm25-634165.pdf) if you are a guardian of a participant under 18 years of age.

6 PUBLICITY

6.1 To the extent applicable, you consent to:

Our use of your name and/or image in Our publicity for the Event and in such promotional materials as We see fit whether now or in the future, anywhere in the world;

Our ownership of any intellectual property rights in your entry and to this end you will assign to Us, with full title guarantee, all intellectual property rights in your entry;

waiving all moral rights in your entry; and

the exploitation by Us (or any third parties We authorise) of your entry in any way We see fit and in any media;

6.2 You agree that you will not be entitled to any payment for any use by Us according to condition 6.1, and you will sign such documents as We reasonably request to confirm this.

7 LIMITATION OF LIABILITY

7.1 We shall not be responsible for any costs incurred by you in submitting an entry or in relation to you participating in the Event.

7.2 We shall not be responsible for any losses you suffer as a result of Our breach of these Terms and Conditions unless those losses were reasonably foreseeable to both you and Us at the date you submitted an entry.

7.3 By entering and participating in the Event, you agree that you are aware of the nature of the Event and any associated physical risks. Subject to condition 7.5(a), We shall not be liable for any injury or illness you may suffer as a result of your participation in the Event.

7.4 We shall not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with the Event for:

loss of revenues, profits, contracts, business or anticipated savings or loss of data; or

any loss of goodwill or reputation; or

any special or indirect or consequential losses, however caused.

7.5 Nothing in these Terms and Conditions shall exclude or limit Our liability:

for death or personal injury resulting from Our negligence or a deliberate act or omission of Us or any of Our officers, employees or agents;

for fraud or fraudulent misrepresentation; or

to the extent that liability cannot by law be excluded or limited.

7.6 We shall not be liable for any damages or losses as a result of failure by Us to deliver the Event as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, any act(s) of God, war or terrorism, or breaches of security.

YOUR LIABILITY TO US AND YOUR STATUTORY RIGHTS

7.7 You agree to fully indemnify Us in respect of all liabilities, damages, claims, actions, expenses (including reasonable legal fees), demands or costs incurred by Us as a result of any breach by You of the Terms and Conditions.

7.8 Nothing contained in these Terms and Conditions shall affect any statutory rights which you may be entitled to as a consumer.

8 YOUR DATA

8.1 Your personal data shall be used solely in accordance with the current data protection legislation and in accordance with Our privacy policy (available via the hyperlink at condition 1.2 above) which governs Our use of the personal data We collect from you.

9 GOVERNING LAW

9.1These Terms and Conditions are governed by and construed in accordance with English Law and any dispute arising from them shall be subject to the exclusive jurisdiction of the English Courts.
